SENTENCING

AGGRAVATION-no higher sentence for not guilty plea, false defence and accusations against police

An accused who is found guilty of the offence with which he is charged after pleading not guilty should not be penalized with a higher sentence simply for putting the prosecution to proof of its case, for offering a false defence and making false accusations against the police (R. v. Skone (1967), 51 Cr. App. R. 165, followed).
